Introduction
Welcome to Telesto! These Terms and Conditions govern your use of the Telesto software product ("the Product"), a cloud web application provided by KEYTECH STRATEGIES SRL ("the Company"). By accessing and using the Product, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, please refrain from using the Product.
License and Usage
2.1. The Company grants you a non-exclusive, non-transferable, limited license to access and use
the Product for the purpose of calculating EBITDA and managing financial data related to software
outsourcing companies, subject to these Terms.
2.2. You shall not distribute, sublicense, or resell the Product or any part of it, or use the Product
for
any unauthorized commercial purpose.
User Accounts
3.1. To access the Product, you may need to create a user account. You are responsible for
maintaining the confidentiality of your account credentials and shall not share your account details
with
third parties.
3.2. You are responsible for
all activities that occur under your account. The Company reserves the right to suspend or terminate
your
account if any unauthorized or suspicious activity is detected.
Data Privacy
4.1. Your use of the Product is subject to the Company's Privacy Policy. By using the Product, you
consent to the collection, storage and processing of your data as described in the Privacy Policy.
4.2. The
Company shall take reasonable measures
to protect your data; however, you acknowledge that no data transmission over the internet can be
entirely
secure and the Company shall not be liable for any data breaches or unauthorized access.
Intellectual Property
5.1. The Product, including all its content, features and functionality, is the exclusive property
of the Company and is protected by copyright, trademark and other intellectual property laws.
5.2. You shall
not modify, reproduce, or create
derivative works of the Product, or remove any proprietary notices or labels.
Limitation of Liability
6.1. The Company shall not be liable for any direct, indirect, incidental, special, or
consequential damages arising out of or in connection with the use or inability to use the Product.
6.2. The Product is provided "as is" without any warranty of any kind and the Company disclaims all
warranties, express or implied.
Changes to the Product and Terms
7.1. The Company reserves the right to modify, suspend, or discontinue any part of
the Product at any time without prior notice.
7.2. The Company may update or amend these Terms from time to
time. It is your responsibility
to review these Terms regularly. Continued use of the Product after any modifications shall constitute
your
acceptance of the revised Terms.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company operates.
